Terms & conditions
Last updated: march 2026
These Terms & Conditions govern the relationship between Emotional Sicily (« Emotional Sicily », « we », « us », « our ») and the traveller or client (« you », « client », « participant ») in relation to bespoke travel design services, multi-day journeys, events, and related services provided or arranged by Emotional Sicily.
By confirming a booking or making any payment toward a service, you acknowledge that you have read, understood, and accepted these Terms & Conditions, and that you are authorised to accept them on behalf of all participants included in the booking.
1. Scope of services
Emotional Sicily designs and delivers bespoke travel experiences, multi-day journeys, and events in Sicily, working in collaboration with a network of local and international suppliers. The exact scope of services included in each booking is defined in the relevant proposal, itinerary, or confirmation shared with you.
2. Package travel — EU rights
Where the services booked constitute a « package » as defined under EU Directive 2015/2302 (transposed into Spanish law by Ley 4/2021), you will benefit from all rights applicable to package travellers, including:
- The right to receive all essential information about the package before booking
- Protection in the event of insolvency of the organiser
- The right to transfer the booking to another person
- The right to cancel the package before departure without paying a cancellation fee in case of unavoidable and extraordinary circumstances at the destination
- The right to a price reduction or compensation for non-performance or improper performance of the services
Where applicable, a pre-contractual information document will be provided prior to booking in accordance with the above regulation.
3. Right of withdrawal for distance contracts
Where a contract is concluded at a distance (online or by correspondence), the EU Consumer Rights Directive generally provides a 14-day right of withdrawal. However, please note that this right does not apply to contracts for travel services, accommodation, car rental, catering, or leisure activities where the contract provides for a specific date or period of performance (Article 103(l) TRLGDCU).
Accordingly, once a booking is confirmed and the deposit has been received, the cancellation policy set out in Section 7 applies.
4. Booking and confirmation
A booking is considered confirmed only when: (i) Emotional Sicily has issued a written confirmation; and (ii) the required deposit or payment has been received. The person making the booking accepts these Terms on behalf of all participants. We reserve the right to decline or withdraw from a booking request where reasonably necessary.
5. Prices
All prices are expressed in Euro (€) unless otherwise specified. Prices are based on the services, inclusions, and assumptions outlined in your proposal. Any modification to the itinerary may result in a revised price. Unless explicitly included, prices do not cover:
- Flights or transportation to/from the destination
- Travel insurance
- Personal expenses and gratuities
- Optional services
- Any service not expressly listed in the proposal
Additional costs may arise due to currency fluctuations, supplier changes, or payment provider fees.
6. Payment terms
Unless otherwise agreed in writing:
- A 30% non-refundable deposit is required to confirm a booking
- The remaining balance is due 60 days prior to the start date
Payments must be made using the methods indicated by Emotional Sicily. Failure to complete payment within the required timeframe may result in cancellation of the booking.
7. Planning and design fees
Where Emotional Sicily provides travel design, research, and planning services, a planning fee may be applied. Such fees compensate professional time and work already carried out and are non-refundable, unless otherwise agreed in writing.
8. Changes requested by the client
Requests for changes after confirmation will be handled on a best-effort basis and are subject to availability, supplier conditions, and potential additional costs. All changes must be confirmed in writing by Emotional Sicily.
9. Cancellation by the client
Cancellations must be submitted in writing to info@emotionalsicily.com. Cancellation fees are calculated based on the date of receipt of written notice:
| Notice period | Cancellation fee |
| 90+ days before start date | Loss of deposit (30% of total price) |
| 61–89 days before start date | 60% of total price |
| 0–60 days before start date | 100% of total price |
Some services may be non-refundable from the time of booking due to supplier conditions, which will be stated in your proposal. No refunds will be issued for unused services once the trip or event has started.
10. Changes or cancellation by Emotional Sicily
We may modify or cancel a service prior to its start due to operational, safety, or external factors. In such cases, we will offer, where possible: a comparable alternative; a rescheduled service; or a refund of payments received for services not delivered. Where changes result from circumstances beyond our reasonable control, our responsibility will be limited to what can reasonably be recovered or reallocated.
11. Suppliers and third parties
Many services are delivered by independent suppliers, including hotels, guides, drivers, venues, and activity providers. Emotional Sicily acts as designer and coordinator of the experience. While we select partners carefully, their services remain subject to their own operational conditions and terms.
12. Travel insurance
Travel insurance is not included in the price. We strongly recommend that you obtain comprehensive insurance covering: cancellation; medical expenses and repatriation; personal belongings; and activities included in your itinerary. You are responsible for ensuring that your coverage is appropriate for the services booked.
13. Travel documentation
You are responsible for ensuring that all required documents (passport, visa, health requirements, etc.) are valid and in order for travel. Emotional Sicily is not responsible for any issues arising from incomplete or incorrect documentation.
14. Health and special requirements
You must inform us in advance of any medical condition, dietary restriction, or special requirement that may affect your participation. We will make reasonable efforts to accommodate such requests, but cannot guarantee availability in all cases. Please refer to our Privacy Policy for information on how we handle this data.
15. Conduct and participation
Participants are expected to: respect local laws, culture, and natural environments; follow the instructions of guides and suppliers; and behave in a manner that does not disrupt the experience for others. We reserve the right to withdraw services without refund in cases of serious misconduct or safety concerns.
16. Force majeure
Emotional Sicily shall not be held liable for failure or delay in performance due to events beyond reasonable control, including but not limited to: natural disasters, extreme weather, pandemics, travel restrictions, strikes, or political instability.
17. Complaints
Any issue arising during the service must be communicated promptly to allow us to address it in real time. If unresolved, complaints must be submitted in writing to info@emotionalsicily.com within 14 days of the end of the service.
18. Online Dispute Resolution (ODR)
If a dispute cannot be resolved directly, EU consumers have the right to use the European Commission’s Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr
Our contact email for dispute resolution purposes is: info@emotionalsicily.com
19. Images and media
During experiences or events, photographs or videos may be taken. Where required by applicable law, explicit consent will be requested before using identifiable images for promotional purposes. Please refer to our Privacy Policy for further details.
20. Limitation of liability
Nothing in these Terms excludes liability where such exclusion is not permitted by applicable consumer protection law. To the extent permitted, Emotional Sicily’s liability is limited to the total amount paid for the relevant service. We are not liable for: indirect or consequential losses; circumstances beyond our reasonable control; acts or omissions of third-party suppliers; or client actions or decisions.
21. Data protection
Personal data is processed in accordance with our Privacy Policy, available on our website.
22. Intellectual property
All content, materials, itineraries, and concepts created by Emotional Sicily remain our intellectual property unless otherwise agreed in writing.
23. Governing law and jurisdiction
These Terms are governed by Spanish law. For disputes involving EU consumers, jurisdiction shall be determined in accordance with applicable consumer protection regulations, which may entitle consumers to bring proceedings before the courts of their place of residence within the European Union.
